Privacy & Terms

This Master Agreement is a legally binding contract between you (“Client,” “you,” or “your”) and ETHĒA LLC (“ETHĒA,” “Company,” “we,” “us,” or “our”). By accessing our digital services, booking a class, purchasing a membership, or entering our studio, you acknowledge that you have read, understood, and voluntarily agreed to these terms.

Age Requirements: You must be at least 18 years of age to create an account or purchase memberships independently. Clients aged 16–17 may participate only with written parental or legal guardian consent signed in-person at the studio.
Account Security: You are responsible for maintaining the confidentiality of your login credentials via Mariana Tek. You agree to provide accurate information and notify us immediately of any unauthorized account use.

All sessions and class packs must be paid for in advance and are non-refundable except in the case of studio-initiated closures.

Late Fees & No-Shows: Failure to cancel within the required window or a "no-show" will result in the automatic forfeiture of the class credit PLUS a $20 fee charged to the card on file.
Expiration: 1 and 5-packs expire in 60 days; 10-packs expire in 90 days.
Waitlists: If a spot opens more than two hours before class, you will be automatically added and notified. Once added, you are subject to the standard cancellation policy. We recommend arriving at the studio early if you are on the waitlist to claim any last-minute openings.

Check-in & Late Entry: We recommend arriving 10 minutes early. No entry is permitted more than five minutes after class has started. Late arrivals denied entry will be treated as a "Late Cancellation."
Amenities: Mats and towels provided by ETHĒA remain the property of the studio and must be returned after each session.
Valuables: Lockers are provided for convenience. ETHĒA is not responsible for the loss, theft, or damage of any personal property.

Recurring Billing: Memberships authorize ETHĒA to charge your payment method on a recurring basis. Cancellations take effect at the end of the current billing cycle; no partial refunds are offered.

Price Changes: ETHĒA may adjust pricing with 30 days’ notice via email or your Mariana Tek account.

PLEASE READ THE FOLLOWING SECTIONS CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS:

HEALTH REPRESENTATION: BY PARTICIPATING, YOU REPRESENT THAT YOU ARE PHYSICALLY AND MENTALLY CAPABLE OF INTENSE EXERCISE, HAVE DISCLOSED LIMITING CONDITIONS TO A DOCTOR, AND HAVE RECEIVED MEDICAL CLEARANCE. YOU AGREE NOT TO ATTEND CLASS IF YOU HAVE SYMPTOMS OF COMMUNICABLE DISEASE.
ASSUMPTION OF RISK: YOU ACKNOWLEDGE THAT PILATES-BASED MOVEMENT, STRENGTH TRAINING, AND THE USE OF SPECIALIZED EQUIPMENT CARRY INHERENT RISKS OF INJURY. YOU VOLUNTARILY ACCEPT THESE RISKS.
RELEASE OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS ETHĒA LLC, ITS OWNERS, AND STAFF FROM ANY AND ALL CLAIMS, ACTIONS, OR LOSSES ARISING OUT OF YOUR PARTICIPATION, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ILLNESS, OR THEFT, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE.
OFF-SITE EVENTS: THESE TERMS APPLY TO ALL ETHĒA EXPERIENCES, INCLUDING RETREATS AND POP-UPS. FOR SPECIFIC OFF-SITE EVENTS, ETHĒA MAY REQUIRE PROOF OF PERSONAL PARTICIPANT INSURANCE. ETHĒA IS NOT LIABLE FOR INJURIES CAUSED BY THIRD-PARTY VENUES OR PARTNER EQUIPMENT.

Ownership: All website content, logos, and media are the property of ETHĒA LLC.
Media Release: By attending, you grant ETHĒA LLC the perpetual right to use photographs or videos of you for marketing purposes. If you prefer not to be filmed, please inform staff before class.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Recurring Billing: By purchasing a membership, you authorize ETHĒA to charge your payment method on a recurring basis until canceled.
Cancellations: Membership cancellations take effect at the end of the current billing period; we do not offer partial refunds.
Price Changes: We reserve the right to adjust pricing with 30 days’ notice via email or your Mariana Tek account.

Governing Law: These terms are governed by the laws of the State of New York.
Arbitration: you agree that any dispute that cannot be resolved privately shall be settled via binding arbitration in new york county, ny. you hereby waive your right to a jury trial.

Force Majeure: ETHĒA LLC is not liable for failure to perform (including studio closures) due to causes beyond its reasonable control, such as natural disasters or public health emergencies.
Amendments: We reserve the right to update these Terms at any time. Continued participation after updates constitutes acceptance of the new terms.
